Here you will find information to assist in your purchases.
All users of our products and services and websites are subject to the agreements below.

These Terms and Conditions governs your purchase and use of all Services offered by us, as may be further described in this Agreement or any Order. This Agreement applies to you and your employees, agents, contractors, or other users who obtain Services from us (each such person or entity being a “User”). You must register with us and accept the terms of this Agreement in order to use the Services. BY REGISTERING FOR AND USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE THAT YOU AND YOUR USERS WILL BE BOUND BY ALL TERMS AND CONDITIONS OF THIS AGREEMENT.

This Agreement is the complete and exclusive agreement between you and us regarding its subject matter and supersedes and replaces any prior agreement, understanding, or communication, written or oral.

1 Definitions

Business Day means 8:00 a.m. - 5:00 p.m. New Zealand Standard Time (NZST) for services provided in Asia Pacific.

Cancellation Date is defined based on the Cancellation Request, product line and contract term.

Cancellation Request” means a written based service cancellation request submitted via support ticket. To schedule your account for cancellation, please login or use the contact form and submit a ticket with subject (class) “Cancellation". In the Answer field detailing the service you wish to cancel and the date you request services to be cancelled. This will ensure that your account is processed for cancellation and will generate an email that will be sent to you regarding full details of your request as well as the offline date of your service/server. Adonis Technology is not responsible for continued invoicing if the above method is not followed.

Confidential Information” means all information disclosed by either party to the other, whether before or after the effective date of the Agreement, that the recipient should reasonably understand to be confidential, including without limitation: (a) for you, all information transmitted to or from, or stored on, KOK Ltd's, its subsidiaries, contractors, or partners systems. Information that is developed by either party on its own, without reference to the other’s Confidential Information, or that becomes available to either party other than through breach of the Agreement or applicable law, will not be considered “Confidential Information” of the other party.

EFT” means Electronic Fund Transfer.

Order” means either: (a) the online order that you submit to KOK Living via our Website, or (b) any other written order (either in electronic or paper form) provided to you by KOK Ltd, its subsidiaries or partners for signature that describes the Services you are purchasing, and that is signed by you, either manually or electronically.

Third Party Products” means third party software or products that may provide to you under this Agreement.

Third Party Vendors” means certain reseller and other relationships that KOK Ltd has established with certain commercial vendors. .

2.1 Order Fulfilment

While we make every effort to fill orders quickly delays can be caused through delayed stock and out of stock components. While we make every effort to keep our website stocks up to date it is impossible to be 100% reliable. the customer, therefore, accepts that the following timetables will be applied ordered items.

  • In stock items 5 working days.
  • Out of stock items take approximately 10 to 15 working days depending on manufacturers stock.

KOK Ltd will make every effort to keep the customer fully appraised of their order via email and/or thier payment gateway such as Paypal, and will advise as soon as the order has been dispatched.

Quantity orders over 10 items

While KOK Ltd is more than happy to fill your order for a quantity of ten (10) or more of any given item in our inventory on a single purchase order, please understand that an order of that size, once purchase is completed, is automatically non-refundable. All other specific conditions related to the ordered item still apply, including any and all stipulations relative to any available replacement return policies.

Downloadable Software

All sales of Applications are final. We do not accept returns of downloadable software. Software may require you to use a computer or other device meeting minimum system requirements, and you are responsible for ensuring that your computer or device meets Software system requirements prior to purchase. Generally, Software system requirements are available on or from product detail pages. Once you have purchased a downloadable product, we encourage you to download it, if applicable, and to access it promptly to ensure that you have received it. You are responsible for downloading and confirming your ability to access software within thirty (30) days after purchase and bear all risk of loss thereafter, including any loss due to a computer or hard drive crash. We will usually continue to make purchased software available in the KOK Ltd Order History Page for additional activations or copies even after this thirty (30) day period, but we may, from time to time, remove without notice because of the Software provider's licensing restrictions or for other reasons. KOK Ltd will not be liable to you if any Software is removed from the Order History Page or otherwise becomes unavailable for additional activation or copies. If you are unable to successfully download or access an Application after having reviewed our online help resources, please contact our support services.

2.2 No longer available and out of Stock Items

If KOK Ltd no longer carries an item that has been ordered or an item that is sent in for replacement, or if that item is simply out of stock, the item will be sent to our Back-Order Department. You will be notified via email of two options: 1) KOK Ltd can send you a comparable replacement item, or 2) KOK Ltd can issue you a credit note at the purchase price. A refund may not exceed the original invoice price.

2.3 Open Box Sale Items

We may sell items that are listed as open-box. Because these items are sold at greatly reduced prices, they are subject to a return within 15 days for refund-only policy. No replacement will be issued and no warranty applies to Open-Box items. Open-Box items must be returned within 15 days of the applicable invoice date or no refund will be available. Return constitutes receipt of the product by KOK Ltd, and not the mere issuance of an RMA. KOK Ltd cannot provide replacement service for these items. The entire risk as to the quality and performance of these items is with the buyer. These items have been tested for functionality, but may have superficial physical defects including, but not limited to, scratches, dings or dents. Should these items exhibit a functional defect following their purchase, the buyer (not the manufacturer, distributor, or KOK Ltd) assumes the entire cost of all necessary servicing or repairs, unless otherwise required by law. These items are not covered by any satisfaction guarantee.

If you purchase an Open-Box product KOK Ltd guarantees only that you will receive the product itself; accessories MAY OR MAY NOT BE INCLUDED. KOK Ltd will not send you a missing accessory, even if the missing accessory is required in order to properly make use of all the product’s advertised functions.

2.4 Warranties

KOK Ltd provides an express Warranty on all goods supplied. This warranty is One (1) year, unless otherwise stated. The warranty includes parts and labour and is expressed as follows:

  1. Items are subject to the manufacturers’ warranties only. We will pass on the benefit of those warranties to you, without being directly liable to you under any warranty.
  2. Where goods are subject to a return to base warranty, you are responsible for returning them to us or the manufacturer (as provided by the warranty) and are solely responsible for freight charges.
  3. A warranty may be voided by unreasonable use, damage or misuse, negligent installation or operation, inadequate packaging, cleaning or maintenance, unauthorised repairs, modifications or the addition of hardware, software or consumables not intended for the items use.
  4. Where the product is a manufacturer only warranty, it will be stated on that product's information section. Manufacturers' warranty details are typically available at the manufacturer's website. Detailed manufacturer warranty information can also be obtained for free by contacting our support department. Please note that products in this category are non-refundable unless otherwise indicated.
  5. Non manufacturer only warranties are to be returned to Adonis technology for servicing, replacement or refund. Customers must raise an RMA/Warranty request where they will be advised the local office in their country to return the item. Failure to raise the support request may result in delay to which you accept full responsibility. KOK Ltd will make every effort to deal with warranty requests as quickly as possible.

A warranty may be voided by unreasonable use, damage or misuse, negligent installation or operation, inadequate packaging, cleaning or maintenance, unauthorised repairs, modifications or the addition of hardware, software or consumables not intended for the items use.

2.5 Credit Card Payments

The buyer acknowledges that the buyer will not under any circumstances instigate a chargeback for the goods purchased unless the goods have not been dispatched within the timeframes specified above or otherwise agreed by the parties. The buyer further acknowledges that any dispute, or problem will be raised with KOK Ltd immediately and no action shall be commenced unless mediation with an independent third party has failed. Where the product cannot be delivered as arranged, KOK Ltd is happy to instigate a full refund.

2.6 Export Regulations

The commodities listed herein on this Site may be subject to U.S. export control laws and regulations, including without limitation the Export Administration Regulations. Any export, re-export, or transfer of these commodities must be conducted in compliance with such applicable laws and regulations.

2.7 Refund and Disputes.

Except where expressly provided in this Agreement, all payments to KOK Ltd are nonrefundable. This includes but is not limited to any applicable setup fees and subsequent charges, regardless of usage. You must report any overcharges or billing disputes to KOK Ltd within 30 days from the date of invoice to you.

Where a refund is applicable it shall be subject to the following policy:

You acknowledge and accept that all purchases are final and any refund will only be processed upon receipt of the goods being returned within 15 days and providing that they are in new and unused condition, with all original packaging, accessories, instructions, etc. You acknowledge that a restocking fee of 20% will be charged on returned product. No return will be accepted on used products. For video games, software, CDs, and DVDs, returns will be accepted only if items are unopened. In the event of a manufacturing defect or warranty issue, we will gladly exchange it for the identical item on a return to base basis.

The following conditions are not acceptable for return, and will result in the merchandise you have returned to KOK Ltd being returned to you at your expense:

  • Items exhibiting physical damage
  • Items that are missing the manufacturer label containing model number, part number or serial number
  • Items that are missing the manufacturer warranty label
  • Items returned without all included accessories, bonus games, and documentation
  • Kit items that are not returned as a complete set
  • Items that do not include all protective covers and casings

Gift Cards

Adonis Technology Gift Cards are redeemable to purchase goods or pay accounts at participating businesses:

Gift Cards are not redeemable for cash
Gift Cards Never expire

Gift cards are emailed to you and can be gifted to any other user or placed on your account for use at anytime through our checkout, paying your invoice through our website, or by emailing us to add it to your invoice. There is No limit on the number of Gift Cards you can purchase.

If you purchase a Gift card using Credit Card, Paypal, Afterpay, or other system that is not a bank transfer, as surcharge applies and will be debited to your account/Gift Card balance.

Paypal charges 3.4% Fixed
Visa and Mastercard charge 3.4% fixed
AMEX typically charges 1.43% + $0.10 to 3.30% + $0.10 per transaction

eWallet

Adonis Technology eWallet is usable to purchase goods or pay accounts at participating businesses:

eWallet balances Never expire
eWallets are Non transferable - if you wish to gift the funds please use our Gift cards

Funds are placed into your ewallet and usable at anytime through our checkout, paying your invoice through our website, or by emailing us to add it to your invoice.
No limit on amount you can purchase.
Surcharge applies when paid for by credit card or afterpay

If you purchase a Gift card using Credit Card, Paypal, Afterpay, or other system that is not a bank transfer, as surcharge applies and will be debited to your account/Gift Card balance.

Returns

Gift Cards and eWallet's are non refundable after purchase is completed, so choose carefully when allocating credit to your chosen item.

Closed accounts that have credit shall have the credit applied in this order:

  1. Payment to any outstanding of a users account​
  2. Used for any purchase on participating websites
  3. If the credit relates to an electricity account with Adonis Energy, any remaining balance after a customer's account is brought into credit from their final reading shall be refunded to the users payment method at the time of order / purchase.
  4. If the Adonis Energy credit is accumulated from rewards, such credit shall be applied on the same basis as clause 10(1) and 10(2) of this returns policy and is not redeemable for cash.

Your pack shipment

Packages for in stock items are generally dispatched within 7 days after receipt of payment and are shipped via NZPOST with tracking and drop-off without signature. Whichever shipment choice you make, we will provide you with a link to track your package online via the shipping company.

Shipping fees include handling and packing fees as well as postage costs. Handling fees are fixed, whereas transport fees vary according to total size and weight of the shipment. We advise you to group your items in one order. We cannot group two distinct orders placed separately, and shipping fees will apply to each of them. Your package will be dispatched at your own risk, but special care is taken to protect objects.

Boxes are amply sized and your items are well-protected. If you open and find you package has been damaged, please notify us immediately. Failure to notify is within 7 days will result in difficulty or our inability to process your claim, so please do not hesitate in contacting us if your package is damaged.

Returns

Please do not immediately return your goods if you find them to be damaged or you are claiming a warranty repair. Please contact us first for an RMA authorization before returning your item. Refer to clause 2.7 Sales Policy for full details on refunds and returns.
